Terms and Conditions
Last updated 2026-10-30
Welcome to Creatly! These Terms and Conditions (“Terms”) apply to your use of creatly.me and related services (the “Platform”), operated by AIKAY TECHNOLOGIES PRIVATE LIMITED (Creatly, “we”, “us”, or “our”).
By using the Platform, you agree to these Terms, our Privacy Policy, our Refund Policy, and our Content Policy. If you do not agree, please do not use the Platform.
1. About Creatly
Creatly is a platform that helps creators sell digital products, services, subscriptions, and memberships to their audience. We operate as an “Intermediary” under the Information Technology Act, 2000. We provide the technology, but we do not create or own the products that Creators sell.
2. Who can use Creatly
You can use Creatly if you are:
- At least 18 years old, and
- Legally allowed to enter into a contract under Indian law.
If you are signing up on behalf of a company, you confirm that you have the authority to do so.
3. Your account
When you sign up, you must provide accurate information. You are responsible for keeping your password safe and for everything that happens in your account. If you notice any unauthorized access, let us know right away.
We may ask you to verify your identity (KYC) at any time. If you don't complete verification, we may suspend or close your account.
4. Plans and payments
Creatly offers Free, Pro, Pro+, and Ultimate plans. Pricing and features are listed on our pricing page.
- Subscriptions are billed monthly or annually through Razorpay.
- Auto-renewal: Paid plans renew automatically. You'll get a notification at least 24 hours before each charge, as required by RBI rules.
- Cancellation: You can cancel anytime from your account. You'll keep access until the end of your billing cycle. Subscription fees paid are non-refundable except where required by law.
- Taxes: All fees are exclusive of applicable taxes, which are charged where required. Payment receipts are available in your dashboard.
5. What creators can sell
Creators can sell digital products, services, courses, subscriptions, and memberships through Creatly. Creators are fully responsible for:
- The accuracy of their listings, prices, and delivery
- Customer support for their products
- Their own taxes (income tax, GST) on the sales they make
What's not allowed
You cannot use Creatly to sell or share:
- Sexual or adult content of any kind, including nudity, pornography, erotic material, sexual or escort services, and “playboy” or companionship job offers, even if everyone involved is an adult and has consented
- Intimate, private or sexual images or videos of a real person, whether leaked, secretly recorded, morphed or made with AI (deepfakes)
- Any content that sexualises, exploits or endangers children
- Content that promotes violence, terrorism, self-harm or suicide
- Anything illegal in India (drugs, weapons, counterfeit goods, etc.)
- Content that infringes someone else's copyright or trademark, or that you don't have the right to sell
- MLM, pyramid, or chain-marketing schemes
- Misleading offers, fake job offers, or fake guarantees
- Hateful, abusive, defamatory, or harassing content
- Gambling or betting services without proper licenses
- Cryptocurrency or financial securities without regulatory approval
- Malware or anything harmful to users
- Anything else prohibited under Indian law
If you break these rules, we may remove your listings, withhold, refund or reverse the payouts on the sales involved, suspend or permanently ban your account, and report you to law enforcement. Intimate content of a real person, or any content involving children, is removed immediately, the account is permanently banned, and we report it to the authorities. A person whose account has been permanently banned may not open another account.
Our Content Policy explains these rules in more detail.
6. Payouts to creators
Creator payouts are processed through our payment partners (currently Razorpay Route, with Cashfree Easy Split as an alternative) using linked accounts, in line with RBI rules.
To receive payouts, you must:
- Complete KYC (PAN, bank account, etc.)
- Have a valid Indian bank account in your or your business's name
Settlement: Payouts happen on the schedule shown in your dashboard, after we deduct:
- Our platform fee (0 to 6% based on your plan)
- Our marketplace fee, on sales the Creatly marketplace brings you (section 7)
- Payment gateway fees charged by the payment partner
- Any taxes applicable to those fees
If a payment is reversed (chargeback or refund), the amount will be deducted from your future payouts.
7. The Creatly marketplace
The Creatly marketplace is where buyers browse and search products from many Creators on Creatly. Products are listed on it by default. Each product the marketplace can list has a Launch on Creatly marketplace switch in the product form, and the Marketplace page of your dashboard has a Show my products on the Creatly marketplace switch for all your products. Turn either off to take that product, or all your products, off the marketplace.
We decide which products the marketplace shows and in what order, as described on its How we rank page, and we may take any product off it. A product taken off the marketplace stays on your store.
The marketplace fee
- Sales the marketplace brings you: your plan fee plus 10%.
- All your other sales: your plan fee.
Your plan fee is our platform fee for your plan (section 6). The extra 10% is the marketplace fee: 10% of the price the buyer pays for that sale, shown as its own line on the sale and deducted from your payout with the other fees in section 6. Buyers pay the same price on the marketplace as on your store.
- What counts: a sale is one the marketplace brings you when the buyer came to that product from the marketplace on the day of the sale or in the 6 days before it, and the product is still on the marketplace when the buyer places the order. It makes no difference whether they came from an ordinary listing or a Sponsored one. A link to that product in Creatly's weekly email counts as coming from the marketplace.
- When it starts: the marketplace fee applies on sales made on or after 00:00 India time (IST) on 31 December 2026. Sales made before that date pay your plan fee only.
- Memberships: a membership the marketplace brought you pays the marketplace fee on its renewals only if its first order was made on or after the start date, and only while the product is still on the marketplace. If you take it off the marketplace, later renewals pay your plan fee only.
8. Sponsored views
Sponsored views put your products in marked places among marketplace results. You buy them in advance, in packs, from the Marketplace page of your dashboard, at the prices shown there.
- Paid in advance: you pay for a pack once, before any of its views are used. A pack is not a subscription and does not renew.
- What a view is: one view is used when at least half of one of your Sponsored products is on a buyer's screen for at least 1 continuous second, in a real browser. A buyer is counted once per product per calendar day (Indian Standard Time).
- Views never expire: views you have bought stay on your account until they are used.
- No cash refunds: views are not refunded as cash, and cannot be moved to another account.
- Which products: you choose which of your products on the marketplace are Sponsored. After your first pack, those that can be Sponsored are switched on, and you can switch any of them off. A product that is off the marketplace or hidden is not shown in Sponsored places and uses no views while it is off.
- How they show: every Sponsored place carries the word Sponsored. Paying for Sponsored never changes how the normal results are ranked, which follow the same rules for everyone, set out on the marketplace's How we rank page. How quickly views are used depends on how many buyers visit the marketplace, so we do not promise a number of views in any period. When your views run out, your products stop showing in Sponsored places until you buy more.
9. Refunds
- Subscription fees paid to Creatly are non-refundable.
- Products sold by creators. All sales are final. Once you've paid a creator, there are no refunds, whether you change your mind, don't use it, or don't like it. If a creator cancels a session, they'll offer you a new time. This doesn't take away rights the law gives you, for example if what you paid for is never delivered. See our Refund Policy.
10. Content ownership
- Your content stays yours. Creators own the content and products they upload.
- License to us: By uploading content, you give us a non-exclusive, worldwide, royalty-free license to host, display, and distribute it on the Platform, only as needed to run Creatly. This license ends when you delete your content.
- Buyers get a personal-use license for what they purchase, unless the Creator allows broader use.
- Creatly's brand and software belong to us. You can't copy or reuse them without permission.
If you believe content on Creatly infringes your copyright, email support@creatly.me and we will act on valid notices within 36 hours, as required under Indian law.
11. Suspension and termination
We may suspend or close your account if:
- You break these Terms
- You break the law
- You engage in fraud or abuse
- We're required to do so by a court or government authority
- Your account is inactive for more than 12 months
You can close your account anytime from your settings or by emailing us. Pending payouts will be settled after we deduct any fees, refunds, or chargebacks. Payouts on sales that break these Terms may be withheld, refunded to buyers, or reversed (see section 5).
12. Disclaimer
Creatly is provided “as is.” We don't guarantee that the Platform will always work without bugs, downtime, or errors. We don't warrant the quality of products sold by Creators. That's between the Creator and the Buyer.
13. Limitation of liability
To the extent allowed by law, Creatly is not liable for any indirect, incidental, or consequential damages (like loss of profits, data, or business). Our total liability to you for any claim will not exceed the amount you paid us in the 12 months before the claim, or ₹10,000, whichever is less.
14. Use of your name
By using Creatly, you allow us to use your name, logo, profile picture, and storefront link in our marketing (for example, on our website, social media, or pitch decks) to show that you use Creatly. If you'd rather not, email us at support@creatly.me.
15. Changes to these terms
We may update these Terms from time to time. We'll post changes on this page and update the “Last updated” date. Continued use after changes means you accept the new Terms.
16. Governing law
These Terms are governed by the laws of India. Any disputes will be handled by the courts in Delhi, India.
